Terms of Use. Use of this site signifies your acceptance of all the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, please exit this site immediately. If any provision of our terms and conditions becomes invalid, illegal, or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions contained herein shall not be in any way affected or impaired thereby.
We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted on the PA-Career & NP-Career website. Your continued use of the service after amendments are posted constitutes and acknowledgment and acceptance of the Agreement and its modifications.
Prohibited Uses. Recruiters and employers, including anyone associated with a job board or employment service of any kind are strictly prohibited from logging in as a Job Seeker. Recruiters and Employers are authorized only to register and login in the Employer/Recruiter login or registration page and pay the fees for viewing job seeker profiles. Only legitimate job seekers may login or register through the Job Seeker login or registration page. Anyone else caught doing so may be subject to prosecution. Users may not post any false or inaccurate biographical information, nor may they delete or revise any material posted by another person or entity.
Our site may not be used for unlawful purposes. Users must not post material that infringes on any other intellectual property rights of others or on the privacy rights of others. You must not post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity. You must not post a sexually-explicit image or statement. You must not post material that contains viruses, trojan horses, worms, time bombs, cancelbots or any other device that might cause damage to anyone or to the website.
Members Account. Members will receive a password and account. Members are entirely responsible for any and all activity which occurs under their account, whether authorized or not authorized.
Client Account General Terms and Conditions: Only employees of the company or hospital paying the membership fees are allowed access to our proprietary database. Any member found sharing their username and password with anyone outside of their company or hospital can have their access rejected and may be pursued for damages. You agree to immediately notify PA-Career & NP-Career of any unauthorized uses of the account or any security breaches of said account. Client agrees to pay all attorney's fees and collection costs incurred by P-Career in the event they become necessary to collect monies owed. Client agrees that this Agreement shall be construed according to and governed by the laws of the State of Georgia. Any controversy or claim arising out of or relating to interpretation, enforcement or breach of this agreement shall be resolved by binding arbitration in accordance with Commercial Arbitration Rules for the American Arbitration Association. Arbitration hearings shall be held in Atlanta, Georgia. If PACareer & NPCareer prevail, Client agrees to pay for the reasonable expenses, including attorney’s fees. This paragraph shall be specifically enforceable. The award rendered by the arbiter(s) may be entered and enforced in any court of competent jurisdiction.
Warranties. The PA-Career & NP-Career services and databases are provided on an “as is” basis, without warranty of any kind, express or implied. Users agree that the use of the service is at your sole risk. PA-Career & NP-Career do not guarantee the truthfulness, accuracy, legality, or quality of jobs, CV’s, resumes or other information posted. We are not responsible or promise that an employer will fill a certain job, or that a candidate will find a job using our site. No warranty is made by PA-Career & NP-Career regarding any information, services or products provided with this agreement. PA-Career & NP-Career hereby expressly disclaim any and all warranties, and users agree and acknowledge that no representations of any kind have been made to you regarding the qualifications, abilities, skills or suitability for employment of persons represented in the database.
Users agree and acknowledge that PA-Career and NP-Career do not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
PA-Career’s & NP-Career's Limited Liability. Your sole and exclusive remedy hereunder shall be for you to discontinue your use of the service and terminate this agreement. In no case shall PA-Career & NP-Career, its directors, officers, employees, affiliates, agents or contractors be liable for any direct, indirect, incidental, exemplary, special or consequential damages arising from your use of or otherwise relating to the PA-Career & NP-Career services. Some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages. In such states or jurisdictions, PA-Career’s & NP-Career's liability shall be limited to the extent permitted by law.
Third party sites. PA-Career & NP-Career do not endorse, warrant or guarantee any third-party product or service offered or otherwise accessed using the PA-Career & NP-Career services. We will not be a party to or in any way be responsible for monitoring any transaction between you and any third parties. You hereby release PA-Career & NP-Career from any and all obligations, liability and claims in excess of these liability limitations.
Governing Jurisdiction of the Courts of Georgia. Our database is operated in the state of Georgia, and as such, we are subject to the laws of the state of Georgia, and such laws will govern this agreement. We make no representation that our website or other services are appropriate, legal or available for use in other locations. If you choose to access our site, you agree to do so subject to the internal laws of the state of Georgia, and that the DeKalb County of the State of Georgia shall be the proper place of jurisdiction for the determination of any disputes arising from this agreement. Any controversy or claim arising out of or relating to interpretation, enforcement or breach of this agreement shall be resolved by binding arbitration in accordance with Commercial Arbitration Rules for the American Arbitration Association. Arbitration hearings shall be held in Atlanta, Georgia. If PACareer & NPCareer prevail, client agrees to pay for the reasonable expenses, including attorney’s fees. Disclaimer regarding accuracy of vendor information. Product specifications and other information from any third-party product or services have either been provided by Clients or Advertisers or collected from publicly available sources. While PA-Career & NP-Career make every effort to ensure that the information on this website is accurate, we can make no representations or warranties as to the accuracy or reliability of any information provided on this website.
PA-Career & NP-Career make no warranties or representations whatsoever with regard to any product provided or offered by any Client or Advertiser, and you acknowledge that any reliance on representations and warranties provided by any Client or Advertiser shall be at your own risk.
Indemnification of PA-Career & NP-Career. Users agree to indemnify and hold PA-Career & NP-Career, its officers, directors, owners, managing agents, attorneys, shareholders, employees, affiliates and subsidiaries harmless from any claim or demand, including attorneys’ fees, arbitration fees, mediation fees, expert expenses and all other consequences of every kind, directly or indirectly resulting from any third party due to or arising out of users use of the service, the violation of this agreement, or infringement by user, or other user of the database using user’s computer, of any intellectual property or any other right of any person or entity.
